ABSTRACT

Historical continuity and tradition constitute essential themes in the thought of Nicolás Gómez Dávila. His argumentation – conceptualised in his essay De iure, a Hungarian translation of which was recently published – can essentially be considered an apology for the primacy of customary law. In one of his maxims, the author draws the attention of the reader to this point in just a few short words: „There is no barrier to despotism other than customary law.” Gómez Dávila is renowned mainly for his aphoristic maxims, the escolios, through which he reflected on a wide array of topics, and the origins of which are to be found in his magnificent, private library of thirty thousand volumes. To understand his concept of law and the state, it is essential to consider both the legal-historical context and a survey of the key works in Roman law, legal history, and legal theory. In this paper, I aim to present these important pieces of background information.
