ABSTRACT

The study examines the role of borders and the development of the public law frameworks of cross-border cooperation in the context of European integration. It focuses on the interpretation of the dividing and connecting nature of borders, as well as the legal and institutional conditions of cross-border cooperation. The authors analyse, within the legislative frameworks of the Council of Europe and the European Union, the legal-administrative conditions for establishing cross-border European territorial cooperation, along with the organisational models of cooperation institutionalised at different levels, with particular attention to the institution of the European Grouping of Territorial Cooperation (EGTC). The study also separately examines the public law regulation of cross-border cooperation in Hungary and its role in strengthening European territorial cohesion.
The study highlights a paradox: while the European Union’s cohesion policy seeks to reinforce the connecting role of borders, contemporary European discourse – amid the growing prominence of security challenges – has increasingly emphasised narratives that stress the dividing function of borders. This shift is bringing about a paradigm change in the development of cross-border cooperation and making the need for its reconsideration ever more urgent. As a result of these processes, the new BRIDGEforEU Regulation was adopted in 2025, aiming to provide a flexible and adaptive institutional solution for addressing legal and administrative obstacles in border regions.
